These Terms of Service ("Terms") govern your access to and use of the Modern Salon Owner website (modernsalonowner.com) and the SalonOS platform (app.modernsalonowner.com), both operated by Renuka M ("Modern Salon Owner", "we", "us", "our"). By accessing or using either service, you agree to be bound by these Terms.
Modern Salon Owner provides two services:
You must be at least 18 years old and legally authorised to enter into a binding agreement to use the SalonOS platform. By registering an account, you represent that all information you provide is accurate, current, and complete. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
Access to the SalonOS platform requires a paid subscription. By subscribing, you agree to:
Subscription fees are non-refundable except where required by applicable law or at our sole discretion. We reserve the right to modify pricing with 30 days' advance notice. Continued use after a price change takes effect constitutes acceptance of the new pricing.
You agree to use our services only for lawful purposes and in accordance with these Terms. You must not:
SalonOS enables salon businesses to send WhatsApp messages to their clients via the WhatsApp Business Platform API, provided by Meta Platforms, Inc. By using the WhatsApp messaging features of SalonOS, you agree to:
We reserve the right to suspend or terminate your access to WhatsApp messaging features immediately if we determine, at our sole discretion, that your usage violates these rules or Meta's policies. You are solely responsible for any consequences arising from your non-compliance with WhatsApp's terms.
Your use of our services is also governed by our Privacy Policy, which is incorporated into these Terms by reference. As a salon business using SalonOS, you are the data controller for your client and staff data. You represent that you have the legal right to collect and process that data and to share it with us for the purpose of providing the SalonOS service.
A Data Processing Agreement (DPA) is available on request for businesses that require one under GDPR or similar regulations. Contact hello@modernsalonowner.com.
All content, software, designs, and materials on modernsalonowner.com and app.modernsalonowner.com are owned by or licensed to Modern Salon Owner and are protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable licence to use the SalonOS platform during your active subscription solely for your own internal business purposes.
Free templates and resources downloaded from the marketing website are licensed for your personal or business use. You may not resell, redistribute, or claim ownership of our templates.
We aim to provide reliable access to SalonOS but do not guarantee uninterrupted or error-free service. We may perform scheduled or emergency maintenance that temporarily affects availability. We are not liable for any loss or damage arising from service interruptions beyond our reasonable control.
To the maximum extent permitted by applicable law, Modern Salon Owner and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of revenue, loss of data, or loss of goodwill, arising from your use of or inability to use our services.
Our total aggregate liability to you for any claim arising from or relating to these Terms or our services shall not exceed the total fees paid by you to us in the three months preceding the event giving rise to the claim.
You agree to indemnify and hold harmless Modern Salon Owner, its operators, and affiliates from any claims, losses, damages, liabilities, and expenses (including legal fees) arising from: (a) your use of our services; (b) your violation of these Terms; (c) your violation of any third-party rights including Meta's platform terms; or (d) any data you submit to the platform.
You may cancel your SalonOS subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period. We reserve the right to suspend or terminate your account immediately if you breach these Terms, violate applicable laws, or engage in conduct that we determine to be harmful to other users or to our platform.
Upon termination, your access to the platform will cease. We will retain your data for 90 days after termination, during which you may request a data export. After this period, your data will be permanently deleted.
We may update these Terms from time to time. We will notify you of material changes by email or by displaying a prominent notice within the platform. Continued use of our services after changes take effect constitutes your acceptance of the updated Terms.
These Terms are governed by the laws of India. Any disputes arising from or relating to these Terms shall be subject to the exclusive jurisdiction of the courts located in Tamil Nadu, India.
